She Got Away With Murder

This shows what can happen if you take a case to trial. You never know which way a jury is going to vote. A good attorney can poke holes in even a solid case. Let alone a weak one. This went from a capital murder case down to voluntary manslaughter. I think this defense is nothing more than something concocted by the defense team. Before the other day we never heard anything about Matthew Winkler being abusive.Is their any record anywhere of domestic violence on this man? Reaching this verdict relied solely on "the battered woman syndrome".

The prosecution dropped the ball by seating a ten woman two man jury. The defense played on the sympathy of the female jurors. Ms. Winkler had the premier defense team in the Mid-South. Steve Farese and Leslie Ballin have developed quite an impressive track record. They took this case pro bono and were able to convince others to do the same. I have never seen so many people celebrating and rejoicing. A man getting shot in the back while he was asleep.

  3. It was a unanimous verdict. You didn't watch the trial. So STFU or admit you disrespect the jury system any time there's a verdict from it you don't like.

    North Memphis Woman Shot and Killed During Argument with Boyfriend

    A North Memphis woman is dead after she was shot during an argument with her boyfriend.
    It happened at the couple's home at 1299 Stonewall Street, around 1:30 in the morning on Wednesday, April 25, 2007.

    Memphis Police say the couple got into an argument. At some point the 48 year-old man pulled out a shotgun on his girlfriend. The man tells police the gun went off by accident.

    The 46 year-old woman was shot in the chest. Police say the boyfriend ran next door to a fire station for help. The woman was rushed to the Med in critical condition but died a short time later.

    The boyfriend has been taken downtown to the Shelby County Criminal Justice Center where he will be questioned by Memphis Police Homicide detectives.

    So far, no charges have been filed.

    Grandparents say petition by Mary Winkler for kids should be tossed

    Mary Winkler's recent appeals court petition to regain custody of her three daughters is legally "frivolous" and should be dismissed, according to court papers filed Monday by the parents of her slain husband.
    Dan and Diane Winkler, whose son Matthew Winkler was shot to death last year by Mary Winkler, have had custody of the girls since the shooting and are seeking to adopt them.

    They argue that Mary Winkler's Juvenile Court petition to reclaim custody has properly been stayed while their Chancery Court petition to terminate her parental rights and adopt the children is pending.
    "The filing of an adoption petition in Chancery Court suspends any pending Juvenile Court proceedings pertaining to the children, including custody, until the Chancery Court has ruled on the adoption," attorney Jake Adams of Corinth, Miss., wrote on behalf of the Winklers.

    Mary Winkler voluntarily signed over temporary custody to the grandparents when she was arrested in Orange Beach, Ala., on March 23 last year, the day after she shot her 31-year-old husband in the back in their Selmer home owned by the Fourth Street Church of Christ, where he was the pulpit preacher.

    She was charged with first-degree murder, but after testifying that her husband was abusive to her, a McNairy County Circuit Court jury convicted her of a reduced charge of voluntary manslaughter in April.

    Winkler, 33, who remains free on $750,000 bond, could receive probation or prison time of more than a year when she is sentenced Friday.

    Through her attorneys, she recently filed an emergency appeal asking the Tennessee Court of Appeals to halt her in-laws' termination-adoption case until the Juvenile Court can hear her petition for their immediate return.

    The girls, now ages 9, 7 and 2, have been living with their paternal grandparents in Huntingdon, where their grandfather is a preacher at the Huntingdon Church of Christ.
